Selling/buying A Used Boat: What Documents Do I Give The Buyer/receive From The Seller

The documents that will later be used to transfer or register a boat in Georgia from a private sale may vary, depending if the boat is already registered in Georgia, if the boat has a paper title issued, if the boat has been reported sold, and if the seller is the owner of record in the Georgia registration system. There are many possible scenarios, but these below are the most common.

A;Bill of Sale ;for a boat must have adequate information to positively link the BOS to the boat.

Do Uscg Documented Vessels Need State Registration Or Decals

There’s a lot of confusion over whether – and when – a Coast Guard Documented vessel needs to be registered with the state. The short answer is that UCSG Documented boats never need to be titled with the state, but may need to be registered with the state depending on how long the boat is on the state’s waters.

First, as to the titling of the vessel, a vessel may either be state titled or federally documented, but not both. Think of USCG documentation like your title – that’s really what it is, even though it has another name. In fact, federal law under 46 U.S.C. § 12106 actually prohibits a USCG Documented vessel from being state titled, and a state cannot require a USCG Documented vessel to display numbers.

However, states may still require registration of USCG Documented vessels for tax and other purposes. What’s the difference between the title and the registration? The title is a formal, colored document used to prove and transfer ownership. The registration typically consists of a registration card and an annual state decal which must affixed to the boat. So while the Coast Guard Documentation is your boat’s title, you may have to also register with a state.

From Registration To Ownership

  • Recognizing that Alaskan boat owners have not historically been required to prove boat ownership when registering at DMV, a tiered system exists to help qualifying boat ownersâ transition towards obtaining a boat title in addition to registration, depending on the ownerâs documents.
  • If ownership cannot be established a boat title cannot be issued, and the boat registration must be marked âNo Title Issued â.
  • If after three years the âNo Title Issuedâ registration remains uncontested and there is no undisclosed security interest in the boat, a certificate of title may be issued.

Changing The Name Of A Boat

The name of a boat is not just going to be the name by which you might refer to your boat among your family, friends, or colleagues. It will also be the name under which the boat itself is going to be registered with the corresponding government agencies. That is why, if you want to change the name of the boat, you will need to go through the process of officially changing it with the Canadian vessel registry. There are different ways for you to update your Transport Canada vessel registration, but if you are specifically changing the name then you will have to use the change of vessel name form, which you can find here on our website. You might have to provide a few different names in case your first choice is taken, though, so keep that in mind.

    Bill Of Sale For Boat

A Bill of Sale for a boat must have adequate information to positively link the BOS to the boat, similar to the example WRD BOS.

Owners of Georgia registered boats must notify the Department, in writing, of sale or transfer, theft or recovery, or destruction or abandonment of a boat within 15 days.

The following should be on the BOS:

    • GA or Other State Registration Number
    • HIN #
    • Hull Material
    • Sellers and Buyers Signature

It is a judgment call whether WRD believes the BOS received is adequate to link the vessel to the BOS in a reasonably sufficient manner, or whether other documents such as a transferred title, a manufacturers statement of origin, or other information supports the submitted BOS. A BOS does not have to be witnessed OR notarized, although this is acceptable.

If it is determined that a BOS is not available at all or is not adequate, the customer should obtain an adequate BOS. If a BOS cannot be obtained, the Affidavit of Vessel Ownership process may be completed.

My Registration Expired And Now Im Told The Registration Numbers On My Boat Arent Available And Must Be Changed Why

    Boat Registration Guide: California

When boat registration numbers expire, they become available to be reused. We do this because of the limited quantity of numbers available. While the odds favor that an expired registration number wont be quickly selected by the computer once it expires, it is available upon expiration and if reassigned is no longer available to the previous registrant. We suggest maintaining boat registrations rather than letting them expire. An expired registration incurs an additional $10 late fee at renewal.

Why Do I Have To Pay A Transaction Fee To Register My Boat

In December 2007, DNR first entered into a contract with an outside vendor to design and manage an automated hunting and fishing license and boat registration system. The new license system was required to replace a failing automated licensing system that was not going to be licensed and available to DNR after December 2008. In short, the system was failing and had to be replaced. Absent of a significant funding source to develop and manage a new system in-house, DNR explored contractual options for obtaining a no cost to state contract like those adopted in many other states. Funding for this type of system would be recovered by the addition of a service charge paid by the buyer at the time of the purchase. The current contract includes: boat registration and renewal online, by telephone, and by mail, and requires mailing registration cards and decals to vessel owners. A Service Center operated by the vendor receives about 200,000 calls per year and registers boat, sells licenses and answers questions about boat registration and recreational hunting and fishing licenses.

Updating Addresses And Ports Of Registry

Another way in which you might end up needing to update your registration might be the address or the port of registry to which its tied to. These are both very important components of a boats registration, so if either of these two things change at some point, you will need to update the registration accordingly. If what you are changing isnt your address but your port of registry, that being the main hailing port where your boat is registered, then you will have to make use of a different form. This will be the form for the transfer of port of registry, which is the same form that you would use when changing the name of the vessel. Similarly, there will be a form for you to change the address under which a boat is registered

Now, in the case that you are not changing the name but rather the ownership arrangements themselves, you will have to go through a similar process. What you will have to do is use the form for a transfer of ownership, even if you arent transferring the vessel to someone else. You have to note, however, that in order for someone to be eligible for ownership of the vessel, even if it is shared, they have to be a Canadian citizen, a Canadian resident, or a corporation incorporated under the laws of Canada. If they are any of these, then they can be added to the registry of the vessel along with the current owner.

How Do I Permanently Affix My Hull Identification Number To My Boat

A HIN is required for recreational boats manufactured after November 1, 1972. If the HIN is assigned by DNR, or if the HIN is known but the plate is missing or the HIN not inscribed on the boat, the boat owner is responsible for permanently affixing the HIN to the boat.

Each hull identification number must be carved, burned, stamped, embossed, molded, bonded, or otherwise permanently affixed to the boat so that alteration, removal, or replacement would be obvious. If the number is on a separate plate, the plate must be fastened in such a manner that its removal would normally cause some scarring of or damage to the surrounding hull area. A hull identification number must not be attached to parts of the boat that are removable. The characters of each hull identification number must be no less than one-fourth of an inch high.

Two identical hull identification numbers are required to be displayed on each boat hull.

  • Primary Location. If the hull identification number would not be visible, because of rails, fittings, or other accessories, the number must be affixed as near as possible to the location specified below.
  • On boats with transoms, to the starboard outboard side of the transom within two inches of the top of the transom, gunwale, or hull/deck joint, whichever is lowest.
  • On catamarans and pontoon boats which have readily replaceable hulls, to the aft crossbeam within one foot of the starboard hull attachment.
